SweetChimera is the alias of a professional digital artist finishing up a BFA in Graphic Design. I have over a decade of experience working as a freelance commission artist. I specialize in character illustration, pixel art, and character/creature design.I'm always interested in taking on new kinds of work. ORDER PROCESS

New to commissioning? Here's how I conduct my commission process.STEP 1: SUBMIT AN ORDER FORM
Do this for each artwork you'd like to order.

STEP 2: WAIT FOR A RESPONSE
You will receive a response within 24 hours.
I will reply with a summary of your order to discuss it further. This will involve my asking you questions for clarification. Once this is done, I will give you a price quote.


STEP 3: PAY
Once the order's details are confirmed and you agree to a price quote, I will set up an invoice for you. Once the invoice has been paid, I will start working on your commission.


STEP 4: WAIT WHILE YOUR ARTWORK IS COMPLETED
I will drop in with WIPs of the artwork if you requested them or if I need your input. Please be patient during the waiting process; your art may take a few weeks to complete.
If you have a question about your order, or would like to see a WIP you are welcome to contact me about it via email at any time. You can track the progress of your order on my Trello Queue.


STEP 5: CONFIRM AND RECEIVE YOUR ORDER
Once finished, I'll email you your finished artwork with the opportunity to request additional changes or tweaks, as well as to confirm there are no errors in the composition.
Once everything's finalized and confirmed completed I'll mark your invoice and order as such and send you the final hi-res files.

By purchasing my art, designs, or services, you automatically agree to the following terms and conditions. You as the client are responsible for reading these terms in their entirety prior to purchase.Should you have questions or concerns, please email → sweetchimera.art@gmail.com

SECTION 1: General Terms

The artist rendering these services through the alias SweetChimera may be referred to in this document as any of the following: I, me, my, myself, SweetChimera, the artist.
Clients of SweetChimera for these services may be referred to in this document as any of the following: you, your, yourself, client, owner, buyer, commissioner.
The artist will not serve minors. All clients must be 18 years or older.
All goods and services provided by the artist are digital unless stated otherwise.

SECTION 2: Rights & Agreements

2.1. Artist Rights & Agreements

Service:
The services I provide are up to my sole discretion.
I reserve the right to accept, decline, or cancel any order for any reason at any time.
Copyright:
I retain all copyrights over my work. This includes but is not limited to the freedom to display, modify, and redistribute the work, anytime, anywhere, for any reason.
I do not offer commission services that limit my ability to publicly display the artwork. However, I can post commissioned projects anonymously.I will not resell work that contains a client's intellectual property.

2.2. Client Rights & Agreements

Copyright & Commerical Use:
By purchasing a commission, the client pays for the artist's labor in creating an artwork.
All commissioned artwork is reserved exclusively for personal use. Clients may not use commissioned work in commercial projects or profit from commissioned work in any way.
Clients retain the right to their intellectual property depicted in commissioned work.
Clients may not claim the commissioned work to be their own creation.
Personal Use:
Do not use the work in any involvement with NFTs or AI art training/generation.
Clients may edit the artwork created for them in any reasonable manner (such as coloring sketches, adding backgrounds, etc.), but not in a manner that obfuscates the watermark or suggests my personal endorsement of the client or their use of the artwork (such as to promote oneself, a product, etc.).Clients may publicly display the artwork (such as through icons, site backgrounds, character image galleries) as long as the work is credited via a link to my website sweetchimera.art. Clients must also indicate if the artwork was edited from the original.Clients may not arrange for the redistribution of the artwork (Ex., via a public download page), nor use it in external projects, including noncommercial ones (Ex., clients may not make shirts to distribute with the artwork, but may make one for themself).

SECTION 3: Payment, Fees, Cancellation & Refunds

3.1. Payment, Fees

Payment
All prices and payments are in USD.
Payment is due in advance via Paypal invoice. Work will not begin on an order until payment is received.
Price estimates are not binding as prices are subject to change.
Payment Plans
Payment plans are available for artworks priced greater than $150 USD.
Payment plans include a nonrefundable initial deposit, followed by a predetermined number of installments during a specified time period. The parameters of a payment plan must be agreed upon with the artist before the order can be accepted. Clients will not receive the full completed artwork until all payments have been completed.
Inquire with the artist if you are interested in a payment plan.
Fees:
Special requests or conditions outside of the artist's listed commission services may incur extra fees or otherwise be the basis for increasing the cost of an artwork.
This concerns things that add information not present at the time of the order, things that add great complexity to a composition or the artistic process itself, or contain sensitive themes.

3.3. Order Cancellation & Refunds

Order Cancellation & Requesting Refunds:
The client may contact the artist to cancel their order and/or request a refund for it at any time. Receiving a refund automatically cancels the order.
Orders cancelled by the client cannot be resumed at a later date.
The client is not guaranteed to receive any artwork from orders they cancelled.
The artist may finalize character designs from custom design orders cancelled by the client for public sale or personal use.
If the artist cancels an order due to client misconduct, the client will not receive any artwork and will be barred from the artist's services.Refunds
For orders cancelled by the client, or by the artist due to client misconduct, refunds will be afforded based on the completion status of the artwork at the time of cancellation.
For orders purchased with payment plans, refunds only apply to the amount paid up until the time of cancellation, excluding the nonrefundable initial deposit.If the artist cancels the commission due to personal reasons, the client will receive a full refund regardless of completion status.Refund Conditions:
Orders that are NOT past the sketch phase may receive a 75% refund.
Orders that ARE past the sketch phase or completed are ineligible for refunds.
Sketch-based commissions, once work has begun, are ineligible for refunds.
All premade adoptable and character design sales are ineligible for refunds.

SECTION 4: Process

Delivery
Commissions are delivered via e-mail as a full-size, watermarked digital image file(s).
The client is not entitled to any commission assets outside of what was specified in the original order, including an unwatermarked copy or the original layered files, or alternate versions.The client can request that their commission remain anonymous upon posting.
The artwork may not remain private indefinitely, however publicizing it can be postponed for a short time if it was intended as a gift.
Deadlines
Clients may request that an artwork be completed before a certain date, but this may incur a fee.
Deadlines sooner than a week from order will incur a larger fee.
Some items cannot be expedited.
The artist reserves the right to take extra time to complete the artwork, unless the client paid a fee for the artwork to be completed by a particular date.Style
The artist will simplify character designs according to the limitations of a medium.
The artist will take artistic and stylistic liberties unless the client specifies otherwise.
Reference
Unshaded, drawn references will produce the best results.
Clients may only send reference images that they have the rights to use.
Written or otherwise unclear reference images will be rejected or incur a fee.
The artist will not use AI-generated images as reference.

WIPs (Work in Progress Images)
WIPs images are generally available at any time upon the client's request. However, due to the artistic process of some items, they may not have WIPs available to be shown.
Some items may have WIPs shown for approval. Clients ordering commission items that come with WIPs shown for approval must be able to respond within 24 hours.Clients are encouraged to draw over WIP images to more clearly articulate any changes they want made.Order Edits
All information necessary to complete the commission should be given at the time of ordering. Introduction of additional information may incur a fee.
No requests for major changes to the pose, outfit, or other integral components of a composition will be accepted after the sketch phase. The artist determines what constitutes a major change.
No changes whatsoever can be made to orders with animation after the invoice has been paid.
Edits to Completed Artwork
Clients can request minor edits or alternate versions of completed commissioned artworks.
Edits to completed artworks requested more than 1 week after delivery, that require major changes, or concern details not made clear in the initial order may be declined or incur a fee. The fee will depend on the type and scale of the edit.Errors (uncolored areas, information specified in the initial order that is missing.) will always be corrected, whenever, free of charge.

SECTION 5: Character Designs & Adoptables

The following are additional terms that apply only to custom character designs, adoptables, and the artwork they come with/through. The previous sections' terms still apply.For all Closed Species designs, please refer to the respective species' rules instead.
For all collab designs, please refer to my collaborator's rules instead.

5.1. Usage and Ownership

The artist retains the ownership to the original artwork of the character design, and ownership (that is, right to receive credit for) of the original character design concept, and through that, the ability to create derivative or similar designs.The client gains the right to use (draw, develop, or otherwise depict) the character design both for personal and commercial use. The client may transfer this right to the design to another party.The client MUST, where possible, credit SweetChimera as the original designer (link to sweetchimera.art) wherever the design's reference or original artwork is publicly posted.The client MAY NOT: co-own the design or use the original artwork of the design commercially (said artwork is reserved for use as reference exclusively).
The client may not use the design to promote NFTs, cryptocurrency, bigotry (such as homophobia, transphobia, racism, ableism) or topics like zoophilia or pedophilia; violating this rule will mean the design will be revoked without compensation.

5.2. Editing

Design Edits:
Design owners may edit the design at any frequency in any reasonable manner, but not in a manner that changes it beyond reasonable recognition. As such, the character design may not be completely redesigned or "overhauled." SweetChimera must be credited as a contributing designer, regardless of edits. If the original artwork is modified to apply edits to the design, it must be labelled as edited.
Derivative Designs:
You may not use a character design I have created as the basis for new derivative characters, such as relatives, hybrids, or new or preexisting 'Closed/Open/Personal species'.
You may designate the design as an alternate form of another different design (Ex: a were-form.)

5.3. Resale

You may not resell a design for a price higher than the real monetary value you as the current owner invested in the design.The price the design was initially sold for by SweetChimera ($0 if not initially sold) plus the money you as the current owner spent on commissioning artworks of the design equals real monetary value.You may resell a design for the initial sale price and/or for the value you spent on commissioning artworks of the design, even if the design was received for free or through trade.
You may not add the value of accompanying artwork or merchandise that was not purchased by the you as the current owner.
DO NOT SCALP MY DESIGNS.
Reselling a design for more than its real monetary value is considered scalping and may result in the design being revoked without compensation and resold.
