SECTION 1
General

The client is responsible for reading these terms in their entirety prior to purchase. By purchasing the artist's artwork, designs, or services, you agree to the following terms.

  1. All clients must be 18 years or older to purchase the artist's artwork or services.

  2. All services and artwork provided are at the artist's sole discretion as an independent contractor.

  3. Artwork uses outside of the purposes described in this document require the artist's written consent.

SECTION 2
Ownership and Usage Rights

Copyright

Copyright to all artwork produced shall remain solely with the artist.
The artist retains the right to use, display, and/or monetize the artwork in any way. This typically concerns but is not limited to marketing and self-promotion, publishing any components from its creation behind a paywall (i.e. on Patreon), or repurposing drafts not featured in the final artwork.
RIGHT TO RECEIVE CREDIT The artist shall be afforded credit as the author of the artwork where reasonably possible and appropriate–or where otherwise requested–in all forms of its digital or physical publication, reproduction, or display. Indicate authorship like so:Artist: sweetchimera.art

Licensing

The commissions advertised on this site are for artworks licensed for noncommercial use; Commercial work may have different availability, terms, and rates. Unless permitted by a commercial licensing agreement signed by both client and artist, all artwork–including the original image of character designs–is licensed exclusively for noncommercial purposes.The relevant licensing is conferred when both the artwork has been completed and paid for in full, fees included. The client is permitted use of the final version of the artwork; use of preliminary concepts or drafts, or uses outside of those described in this document requires the artist's written permission.

Usage Rights

ALTERATIONS Clients may alter the artwork in any reasonable manner (coloring sketches etc.), provided the changes are A) not made by a paid third-party, B) the watermark remains legible, and C) the changes do not imply the artist's endorsement. Should the altered artwork be displayed publicly, any modifications must be indicated.DIGITAL USE Clients are permitted to display the work for decorative purposes (icons, social media banners, etc.).PHYSICAL REPRODUCTION of the unaltered work by the client for their own use is permitted but, with the exception of stickers, may not be mass-distributed.LIMITATIONS OF USE Do not mass-distribute artwork in any online or physical marketplace/storefront, even for free. Do not republish the work to a social media/any online gallery without the artist's prior permission. Do not use, reproduce, or publish the artwork in any external projects (YouTube videos, video games, etc.) The artwork may not be used for purposes related to NFTs, or for Machine Learning (AI) training or generation.


SECTION 3
Pricing and Payment

  1. All prices listed are in USD.

  2. All payments shall be made via Paypal invoice.

  3. Payment is due in advance, within three (3) days of invoicing; for orders without payment plans, work will not begin until payment is received in full. If payment is not received, any commission agreement is void and the artist will have no obligation towards the client, and vice versa.

  4. Payment must be made by the client, not a third party individual.

Price estimates are not binding as prices are subject to change.
For items with variable pricing that the price of additional content is dependant on, the variable price is determined by the most complex subject.
PAYMENT PLAN Clients may request a payment plan for any single artwork costing $200 USD or greater. The plans require a non-refundable initial deposit 50% of the total price, with the remaining balance paid in 2–3 installments over a predetermined period.
Details of the plan must be agreed upon with the artist prior to invoicing, and the invoice paid in full before the artwork will be delivered.

Cancellation and Refunds

ORDER CANCELLATION (RIGHT TO REFUSAL) The client may contact the artist to cancel the order at any time. Once cancelled, orders cannot be resumed. The client will not receive the artwork, nor any licensing or usage rights for cancelled orders. The artist retains the right to finalize character designs from cancelled character design orders for public sale or personal use. An order must be cancelled for any refunds to be issued.REFUNDS The client must contact the artist to request a refund.

  1. All adoptable and character design sales–customs included–are final.

  2. Orders that have not progressed past the sketch phase are eligible for a 50% refund.

  3. Orders that have progressed past the sketch phase and sketch-based commissions are ineligible for refunds.

  4. Should the artist cancel the order due to gross client misconduct, the artist will issue a 15% refund and the client will be barred from future services.

  5. Should the artist be unable to complete the order due to personal reasons, the artist will issue a full refund.

  6. For orders with payment plans, refunds will be applied to installments made up to the time of cancellation, excluding the nonrefundable initial deposit.

Fees

Clients may incur fees, priced per-request with payment due immediately, for requests that fall outside standard commission service, add excessive complexity to the art or process, or introduce new information not specified in the original order. Clients will be warned of any fees that may result from a given request.Fees incurred by revisions implemented into the artwork at any point will not be waived or refunded, even if later altered, undone, or absent from the final artwork.CONTENT SPECIFIC FEES The presence of the following content within commissions and/or their reference material may increase the total price of a commission order past the listed prices or price range cap.

  1. COMPLEX DESIGN MARKINGS Intricate markings or patterns that must be closely replicated.

  2. COMPLEX DESIGN STRUCTURE Such as intricate horns, large wings, transparent with a complex interior.

  3. COMPLEX DESIGN ORNAMENTATION Detailed or extensive ornamentation on armor, outfits, or machinery, such as fluted armor, extensive engravings, greebled robotic parts, abundance of delicate accessories.

  4. INADEQUATE REFERENCE (CUSTOM DESIGN FEE) This fee is 250 USD per design for all art types, applying to subjects with grossly incomplete, fragmented, inaccurate, written, or otherwise unclear references that may necessitate the artist designing/redesigning an outfit or character extensively.

  5. PROPS Props not inherent to the character design, especially large or complex props. Examples include vehicles, furniture, instruments, ornamented weapons, dialogue boxes, food, etc.

  6. COMPANIONS Simple mounts or pets, accessory to the subject character. (E.g. on horseback, pet cat, etc.)

  7. BACKGROUND Complex background elements, such as ornamental borders/frames. Primarily applies to art types with no, minimal, or simple backgrounds.

  8. CROWDS Large groups of secondary subjects that often do not have specific designs.


SECTION 4
Commission Process

All information necessary to complete the artwork should be communicated when ordering.REFERENCES Provide the best quality visual references available. Ensure the reference material is consistent and free from obfuscation by watermarks or artifacting. Written, incomplete, or otherwise unclear references may incur additional fees, be treated as an additional design commission, be rejected, or negatively impact the quality of the artwork.STYLE The artist reserves the right to simplify character designs at their discretion for compatibility with the medium. The artist will take artistic and stylistic liberties unless instructed otherwise. Requests for specific stylistic approaches outside the artist's default for a given art type or their typical scope of work may incur additional fees determined by art type and the complexity of the style requested.

WIPs

The artist will provide at least one (1) Work in Progress Image (WIPs) during the sketch phase for client approval of the composition for all art types except all pixel art commissions and sketch-based commissions.Certain artwork types involve clients receiving WIP images to approve before the artist can proceed. Additional WIPs are available any time upon request.

Revisions

The client is responsible for requesting any changes to the artwork. Clients are encouraged to draw over WIPs to indicate the revisions they'd like made. Error correction (mistakes such as uncolored areas, missing markings that were pictured on the reference, etc.) does not count towards revisions, and will always be done whenever requested, for free.REVISIONS OF IN-PROGRESS WORKS Five (5) reasonable revisions are permitted prior to the sketch phase’s completion. Two (2) minor revisions are permitted following the sketch phase. Animated artworks are only permitted one (1) minor revision prior to the animation stage.REVISIONS OF COMPLETED WORKS Revisions to completed artworks will incur a fee, priced per-revision. Animated works cannot be revised further once completed.Subsequent revisions that exceed the allotted number for a given phase will incur a fee, priced per-revision.
Major revisions may be rejected or incur a fee, priced per-revision dependent on both art type and the type and scale of the revision. The artist determines the scale of a revision, and reserves the right to decline any request.

Delivery

DEADLINES Clients can request artwork be completed by a deadline for an additional fee determined by proximity to the deadline and the type of artwork. Some artworks cannot be expedited.By requesting completion by a certain date, clients acknowledge that revisions or requests for WIP approvals may delay the final product. Clients that requested artwork to be completed within a given deadline must remain available to provide feedback on any WIPs sent within 24 hours. The client concedes that the deadline fee will not be refunded if the deadline is missed due to these factors.DELIVERY FORMAT All goods and services provided by the artist are for original digital artworks unless explicitly stated otherwise. No physical products will be provided unless clearly indicated during the order process. Clients are not entitled to anything outside of what was specified and promised in the initial order, including unwatermarked copies, initial sketches, original files, or alternate versions. The client will only receive heavily watermarked or low-resolution versions of the artwork for viewing and review purposes until all payment and fees incurred are paid in full.

  1. Digital artwork will be delivered to the client's email as watermarked image file(s) in .png format if static and/or .gif format if animated. Resolution is 300dpi in RGB colorspace, unless otherwise specified. The dimensions of the work vary with art type. It is the client’s responsibility to save and retain the final product’s digital files.

  2. For physical artworks or those with physical components, the artist agrees to take reasonable care in delivering the product via mail. The client agrees to pay a fee for shipment prior to the product's mailing. Physical artworks require a valid address and addressee name to be delivered.

PUBLICATION HOLD The artist reserves the right to freely publicize completed artworks. Clients may request that their orders be made anonymous if posted to social media. The artist is willing to delay publicizing an artwork, such as for orders meant as gifts, however the delay in publication may not last more than 3 months from the completion date.



SECTION 5
Character Designs & Adoptables

For all designs created via collaboration with another artist, or for Closed Species designs, please disregard these terms and refer to the respective species' or designer's rules instead.The following are supplementary terms that apply to custom character designs, adoptables, and the artwork they come with/through. The previous section's terms apply exclusively to the original artwork of the design.

  1. CHARACTER DESIGNER RIGHTS SweetChimera retains all rights to the original artwork and design concept, including the right to receive credit for creation and the ability to create derivative designs.

  2. CHARACTER DESIGN OWNER The current owner gains both personal and commercial use rights for the design, excluding commercial use of the original artwork. Ownership is transferable independent of the original designer, but may only be held by one person at a time (no co-owning).

  3. CHARACTER DESIGN EDITS The owner may edit (or commission edits of) the design in any reasonable manner, but not such that the design is changed beyond reasonable recognition (no "overhauling"). If the original artwork is modified to apply edits to the design, it must be labelled as edited where publicly displayed.

  4. CHARACTER DESIGN CREDITING The current owner must publicly credit SweetChimera (preferably linking to sweetchimera.art) whenever the design's reference or original artwork (modified or not) is displayed. SweetChimera must be credited as a contributing designer regardless of any edits made to the design.

  5. CHARACTER DESIGN RESALE Do not resell the design for more than its initial sale price plus the real currency amount invested in additional artworks by the current owner. The owner may incorporate the initial sale price into the design's value even if it was acquired through trade or as a gift. If the design was not initially sold by SweetChimera, its initial sale price is zero.

Character Design Limitations of Use:

  1. The design cannot be used as a basis for new character derivatives (e.g., relatives species, etc.).

  2. SweetChimera reserves the right to revoke ownership of the design without compensation and publicly bar the offender from future services if the following limitations of use are violated by the owner: Neither the design in any format nor its original artwork may be used to train AI or to promote NFTs or cryptocurrency, nor may it be used to depict distasteful illicit acts such as zoophilia or pedophilia.
