By purchasing artwork, designs, or services ("work", "works", "artwork") from or created by artist SweetChimera (“the artist”) you as the client (“the client”, “they”) affirm to have read and agree to the following Terms of Service ("Terms") listed below. General

1.1 General All services and artwork provided are at the artist's sole discretion as an independent contractor. The artist reserves the right to refuse service or cancel the commission order for any reason at any time.

1.2 Content The artist will not accept orders containing the following subject matter:

Rights and Agreements

2.1 Copyright Copyright to all work produced and the ability to use it in any manner shall remain solely with the artist. The artist reserves the right to publish any component from the artwork's creation to the public behind a paywall (i.e. on Patreon), or repurpose drafts not featured in the final artwork. The artist will not use the final artwork to create or sell merchandise without client permission.

2.2 License The rates listed on this site are for works licensed for noncommercial use. Unless permitted by a mutually signed commercial licensing agreement, all artworks produced are reserved for noncommercial, personal use by the client.The relevant licensing is conferred once the work is complete and paid for in full.

2.3 Usage Only use of the final version of the work is permitted; use of preliminary concepts or drafts requires the artist's permission. Any use of the work of the work should be in in good faith and in a manner respectful of the original work.The work may not be used for or in association with any monetized, account, platform, or venture be it physical or digital (e.g. promoting your business, as a Patreon banner, etc.). Do not use the work to mint NFTs or in association with blockchain technology.

2.4 Attribution Include author attribution wherever the artwork is republished, reproduced, or displayed.

Pricing & Payment

3.1 Pricing Rates listed are per-subject. All prices are in USD. Price estimates are not binding as prices are subject to change. Pricing for variable or ranged pricing is determined by both subject and composition complexity. For items with variable pricing that the price of additional content is dependent on, the variable price is determined by the most complex subject.

3.2 Payment All payments shall be made in USD via Paypal invoice. Full payment is due in advance upon client's receipt of the invoice; the order may be cancelled by the artist and the client's reserve on the commission slot voided if payment is not received within 72 hours of invoicing. Payment must be made by the client, not a third party individual.Work will not begin until full payment is received. For orders placed with payment plans, work will not begin until the initial deposit is paid, and the completed work will not be delivered until the invoice is paid in full.

3.3 Payment Plans Payment Plans are available upon request for artworks priced $500 USD or more, involving a 50% nonrefundable initial deposit, with the remainder paid in two installments over a set period. Details of the plan must be agreed upon with the artist prior to invoicing, and the invoice paid in full before the deliverable will be sent and/or licensing rights conferred.

3.4 Fees and Price Variations The artist reserves the right to adjust pricing or beyond any listed rates or introduce additional fees to reflect the assessed complexity of an order or revision. Percentage fees are calculated from the art type's highest base price.The client will be notified if their order or revision request would incur additional cost or charges prior to being billed.Designs

Cancellation & Refunds

4.1 Order Cancellation The client may email the artist at sweetchimera.art@gmail.com to cancel the order at any time. Once cancelled, orders cannot be resumed. The client will not receive any further artwork. The client is not conferred licensing or usage rights for the drafts produced by cancelled orders. The artist retains the right to repurpose drafts or concepts from cancelled orders for public sale or personal use.

4.2 Refunds The client must contact the artist to request a refund.

Order Process

5.1 Order Details It is the client's responsibility to provide all information necessary to complete the artwork when ordering.The artist prioritizes visual reference material that is lined, free from obfuscation (by rendering, watermarks, artifacting, etc.), SFW, matches the scope of the artwork (e.g., fullbody reference for a fullbody order), and is consistent between images/views if there are multiple. References that don't meet this criteria are considered inadequate and may negatively impact the quality of the artwork, may incur additional fees initially or for later revisions, or may be rejected.

5.2 Style The artist reserves the right to simplify character designs at their discretion for compatibility with the medium.
The artist will take artistic and stylistic liberties unless requested otherwise. Requests for specific stylistic approaches outside the artist's default for a given art type may incur fees priced by art type and style complexity.

5.3 Work in Progress images (WIPs) Certain artwork types involve clients receiving Work in Progress Image (WIPs) images to approve before the artist can proceed.The artist does not provide additional approval WIP opportunities for Pixel Art category commissions, Sketchpages, Emoji Customs, and non-Flash Chibi types.Additional WIPs are available any time upon request; additional WIPs requested to approve the artwork before the artist can proceed will increase wait time.The client will receive heavily watermarked or low-resolution versions of the artwork for viewing and review purposes until all outstanding balances are paid in full.

5.4 Revisions The client is responsible for requesting any desired revisions.All non-animated artworks are permitted four (4) minor revisions; animated artworks are permitted one (1) minor revision. Subsequent revisions or thsoe requested after an order's completion may be declined or incur additional charges. Animated works cannot be revised further once completed.Revisions that significantly deviate from the original order or concern elements not made clearly comprehensible in the original order or reference material will be done at the artist's discretion, and may incur additional non-refundable charges priced based on art type and the assessed complexity, due in full before work proceeds.


5.5 Error Correction Errors (e.g., uncolored areas, missing details unambiguous in the original reference or order) will be corrected at no extra cost.

5.6 Deadlines The client may request artwork be completed by a deadline for a fee determined by art type and proximity to the deadline. Some requests cannot be fulfilled.By imposing a deadline, clients acknowledge that additional revisions or requests for approval WIPs may delay completion. Clients that impose a deadline must remain available to provide feedback on any WIPs sent within 24 hours. The client concedes that the deadline fee will not be refunded if the deadline is missed due to delays on their part.

5.7 Turnaround Time Most orders are completed within 90 days. The artist reserves the right to take additional time to complete the work if no deadline was specified in the initial order. Commissions are taken and typically prioritized on a first-come, first-served basis, but orders for similar art types may be carried out simultaneously in batches.


5.8 Delivery All goods and services provided by the artist are for original digital artworks, no physical product will be provided unless explicitly stated otherwise. Clients are not entitled to anything outside of what was specifically promised in the initial order, including unwatermarked copies, initial sketches, layered files, or alternate versions.Digital artwork will be delivered to the client's email, or via a browser link to the artwork, as watermarked image file(s) in PNG format if static and/or GIF format if animated. Resolution is 300dpi in RGB colorspace, unless otherwise specified. The dimensions of the work will vary with art type.It is the client’s responsibility to save and retain the final product; the artist may not retain the artwork files following delivery.The artwork will be considered accepted and order complete should the art be delivered and the artist not receive a response from the client within 1 week.


5.9 Publication The artist reserves the right to freely publicize completed orders. The client may request to remain anonymous or unlisted on the artist's public queue, or anonymized when the artist publicizes the completed work. The client may request a delay in publication, lasting up to 2 months after the artwork’s completion date.

Character Designs & Adoptables

The following are supplementary terms that apply to custom character designs, adoptables, and the artwork they come with/through. The previous section's terms apply exclusively to the original artwork of the design.For all designs created via collaboration with another artist, or for Closed Species designs, please disregard these terms and refer to the respective species' or designer's rules instead.

6.1 Designer Rights & Crediting SweetChimera retains all rights to the original artwork and design concept, including the right to receive credit for creation and the ability to create derivative or similar designs.The current owner must publicly credit SweetChimera whenever the design's reference or original artwork (original or modified) is displayed. SweetChimera must be credited as a contributing designer regardless of any edits made to the design. Provide credit like so:Original Design by: sweetchimera.art


6.2 Owner Rights The current owner gains personal and limited commercial use rights for the design. The original artwork of the design may not be used commercially; usage rights for the original artwork of the design are the same as for commissioned work listed above in this TOS. Ownership and its rights are transferrable but may only be held by one person at a time (no co-owning).

6.3 Limitations of Use The design cannot be used as a basis for new character derivatives (e.g., relatives, species, etc.).The artist reserves the right to revoke ownership of the design without compensation and publicly bar the offender from future services if the following limitations of use are violated by the owner:
