Once the invoice is paid, I will begin work on your order. Be patient while your order is in progress; allow several weeks for completion. I will share WIPs (works in progress) for approval as necessary and/or as requested. You can track order progress on my Trello Queue, where I will also upload WIPs between completion stages for you to view at any time. You may reach out to me at any time about your order.


Receive your artwork

I will email you the completed artwork for review and to confirm correct. After final approval, I'll mark your invoice as complete and send the final high-resolution files.

By purchasing my art, designs, or services, you agree to the following terms.Artworks with commercial licensing have different terms. Inquire with the artist for commercial licensing opportunities.
All clients must be 18 years or older to purchase the artist's artwork or services. The artist does not serve minors.


SECTION 1
Ownership and Usage Rights

General

  1. All services and artwork provided are at the artist's sole discretion as an independent contractor.

  2. Artwork uses outside of the purposes described in this document require the artist's written consent.

Copyright

Copyright to all artwork produced shall remain solely with the artist. The artist retains the right to use, display, and/or monetize the artwork in any way. This includes but is not limited to marketing and self-promotion, or publishing any components from its creation behind a paywall (i.e. on Patreon).Right to Receive Credit
The artist shall be afforded credit as the author of the illustration where unobtrusive and appropriate, or where otherwise requested in all forms of publication, reproduction, or display (digital or physical) it is used with. This can be in the form of a link to the artist’s website: sweetchimera.art

Licensing

Unless specifically permitted by a written contract licensing agreement signed by artist and client, all artworks, including the original artworks of adoptable character designs, are only licensed for noncommercial personal use.The relevant licensing is conferred when both the work has been completed by the artist, and all payments and fees owed to the artist have been made in full. The client is permitted use of the final version of their commissioned artwork; use of preliminary concepts or drafts, or for uses outside of those explicitly described in this document requires the artist's written permission.ALTERATIONS Clients may alter the artwork in any reasonable manner (coloring sketches etc.), provided the changes are not made by a paid third-party, the watermark remains legible, and the changes do not imply the artist's endorsement. Should the altered artwork be displayed publicly, any modifications must be indicated.DIGITAL Clients are permitted to use the work for display or decorative purposes (icons, banners, etc.). Credit the work via a link to the artist's website: sweetchimera.artPHYSICAL REPRODUCTION of the unaltered work by the client for their own use is permitted but, with the exception of stickers, may not be mass-redistributed.LIMITATIONS OF USE

  1. Do not use, reproduce, or publish the artwork in any external projects (YouTube videos, video games, etc.)

  2. Do not republish the work to a social media post or account without the artist's prior permission.

  3. Do not distribute or exchange the artwork in any online or physical marketplace/storefront, even for free.

  4. The artwork may not be used for purposes related to NFTs, or for Machine Learning (AI) training or generation.



SECTION 3
Pricing and Payment

  1. All prices listed are in USD. All payments shall be made via Paypal invoice.

  2. Payment must be made by the client, not a third party individual.

  3. Payment is due in advance, within 10 days of the date the invoice is sent. If the artist does not receive payment by midnight PDT 10 days from the invoice date, the commission agreement is void and the artist will have no obligation towards the client, and vice versa.

For items with variable pricing that is consequential to the price of additional content or subjects, price is determined by the most complex subject. Price estimates are not binding as prices are subject to change.PAYMENT PLAN Artworks priced $250 USD or greater qualify for the option of a payment plan. Payment plans require a non-refundable initial deposit followed by installments over a set timeframe. Details of the plan must be agreed upon with the artist prior to purchase, and all payments must be completed before the artwork will be delivered.

Cancellation and Refunds

ORDER CANCELLATION (RIGHT TO REFUSAL) The client may contact the artist to cancel the order at any time. Once cancelled, orders cannot be resumed. The client will not receive the artwork, nor any licensing or usage rights should they cancel the order. The artist retains the right to finalize character designs from cancelled character design orders for public sale or personal use. Requesting a refund automatically cancels an order.REFUNDS The client must contact the artist to request a refund.

  1. All premade adoptable and character design sales are final.

  2. Orders that have not yet progressed past the sketch phase are eligible for a 75% refund.

  3. Should the artist cancel a commission due to client misconduct, the artist will issue a 15% refund and bar the client from future services.

  4. Should the artist cancel the commission due to personal reasons that render them incapable of finishing the artwork, the artist will issue a full refund.

  5. For orders with payment plans, refunds will be applied to installments made up to the time of cancellation, excluding the nonrefundable initial deposit.

  6. Orders that have progressed past the sketch phase, or sketch-based commissions (such as sketchpages) are ineligible for refunds.

Fees

The client may, at any point in the commission process, incur fees, priced per-request and due upon the artwork’s completion should they request revisions to the order or artwork that are outside the artist's standard commission services, add excessive complexity to the artwork or workflow, concern new information or requirements not present in the original order, or exceed the permitted number of revisions for a given phase of the artwork. Fees incurred by revisions implemented/executed at any point that then are further revised, undone, or otherwise no longer visible in the final product shall not be waived.Complexity fees primarily apply to designs with a high level of detail that the client indicates must be replicated exactly as pictured on the reference; complexity fees may not apply to orders where these detail can be approximated.Examples of content that may affect price includes but is not limited to the following:

  1. Sensitive themes, such as sensual, sexual, hyperviolent or gory content

  2. Complex markings or patterns (determining complex markings varies with the art type; but this design I made just meets the threshold of what I'd price as a complex design.)

  3. Certain large or complex bodily traits or props (ex: intricate horns, large wings, transparency with detailed interiors, instruments, furniture)

  4. Highly detailed, ornamented, or structurally complex armor, machinery, or outfits (ex: fluted armor, highly greebled robotic parts, abundance of delicate accessories)

  5. Mounts or pets accessory to the subject character (ex: subject on horseback or running alongside their dog)

  6. Crowds



SECTION 3
Commission Process

All information necessary to complete the artwork should be communicated when ordering.REFERENCES Provide the best quality visual references available. Written, incomplete, or otherwise unclear references may incur additional fees, be rejected, or impact the quality of the artwork.STYLE The artist will take artistic and stylistic liberties unless instructed otherwise. Specific stylistic approaches outside of the artist’s typical scope of work or that outlined in the original order may incur additional fees. The artist reserves the right to simplify character designs where appropriate at their discretion for compatibility with the medium.

WIPs

The artist will provide one (1) Work in Progress Image (WIPs) during the sketch phase for client approval of the composition for all art types except sketch-based commissions. The client is responsible for requesting any changes to the artwork. Depending on art type, the artist will periodically send further WIPs for approval, clarification, or as an update.

  1. Certain artwork types involve clients receiving WIP images to approve before the artist can proceed. Clients are requested to provide feedback within 24 hours.

  2. Clients are encouraged to draw over WIPs to articulate changes they'd like made.

  3. Additional WIPs are available any time upon request, but may delay the art process.

Revisions

The client is responsible for requesting any changes to the artwork. Error correction (mistakes such as uncolored areas, wrong markings, etc.) does not count as a revision, and will always be done whenever requested, for free.REVISIONS OF IN-PROGRESS WORKS Three (3) reasonable revisions are permitted prior to the sketch phase’s completion. Five (5) minor revisions are permitted following the sketch phase. Animated artworks are only permitted two (2) minor revisions total.REVISIONS OF COMPLETED WORKS Revisions to completed artworks will incur a fee, priced per-revision. Animated works cannot be revised further once completed.

Delivery

DEADLINES Clients can request artwork be completed by a deadline for an additional fee, determined by proximity to the deadline. Some artworks cannot be expedited. By requesting completion by a certain date, clients acknowledge that revisions or requests for work-in-progress approvals may delay the final product. The client concedes that the deadline fee will not be refunded if the deadline is missed due to these factors.DELIVERY FORMAT All goods and services provided by the artist are for original digital artworks unless explicitly stated otherwise. No physical products will be provided unless clearly indicated during the order process. Clients are not entitled to anything outside of what was specified and promised in the initial order, including unwatermarked copies, initial sketches, original files, or alternate versions. The client will only receive heavily watermarked or low-resolution versions of the artwork for viewing and review purposes until all payment and fees incurred are paid in full.

  1. Digital artwork will be delivered to the client's email as watermarked image file(s) in .png format if static and/or .gif format if animated. Resolution is 300dpi in RGB colorspace, unless otherwise specified. The dimensions of the work vary with art type. It is the client’s responsibility to save and retain the final product’s digital files.

  2. For physical artworks or those with physical components, the artist agrees to take reasonable care in delivering the product via mail. The client agrees to pay a fee for shipment prior to the product's mailing. Physical artworks require a valid address and addressee name to be delivered.

PUBLICATION HOLD The artist reserves the right to freely publicize completed artworks. Clients may request that their orders be made anonymous if posted to social media. The artist is willing to delay publicizing an artwork, such as for orders meant as gifts, however the delay in publication may not last more than 6 months from the completion date.



SECTION 4
Character Designs & Adoptables

For all designs created via collaboration with another artist, or for Closed Species designs, please disregard these terms and refer to the respective species' or designer's rules instead.The following are additional terms that apply only to custom character designs, adoptables, and the artwork they come with/through. The previous sections' terms apply to the original artwork of the design.

  1. Character Designer Rights: SweetChimera retains all rights to the original artwork and design concept, including credit for creation and the ability to create derivative designs.

  2. Character Owner Rights: The current owner gains both personal and commercial use rights for the design, excluding commercial use of the original artwork. Ownership is transferable, but may only be held by one person at a time (no co-owning).

  3. Character Design Edits: Design owners may edit or commission edits of the design at their discretion in any reasonable manner, but not such that the design is changed beyond reasonable recognition (no "overhauling"). If the original artwork is modified to apply edits to the design, it must be labelled as edited.

  4. Character Designer Crediting: The current owner must publicly credit SweetChimera (preferably linking to sweetchimera.art) whenever the design's reference or original artwork is displayed. SweetChimera must be credited as a contributing designer regardless of any edits made to the design.

  5. Character Design Resale: Do not resell the design for more than its initial sale price plus the dollar amount the current owner invested in additional artworks. You may incorporate the initial sale price into the design's value even if you acquired ownership of it through trade or as a gift. If the design was not initially sold by me, its initial sale price is zero.

Character Design Limitations of Use:

  1. The design cannot be used as a basis for new character derivatives (e.g., relatives species, etc.).

  2. SweetChimera reserves the right to revoke ownership of the design without compensation and publicly bar the offender from future services if the following limitations of use are violated by the owner: Neither the design nor its original artwork may be used to train AI or to promote NFTs, cryptocurrency, or bigoted ideologies, nor may it be used to depict distasteful illicit acts such as zoophilia or pedophilia.
